These Terms of Use govern your access to and use of upliftedrealty.com (the “Site”), operated by Konstantin Bogatyrev, P.A., doing business as Uplifted Realty (“Uplifted Realty,” “we,” “us,” or “our”). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. About Us

Uplifted Realty is a licensed Florida real estate brokerage. Konstantin Bogatyrev is a licensed Florida real estate broker, license no. [BK3461256], and the brokerage is licensed under [CQ1074736]. We are a member of the Orlando Regional REALTOR® Association and Florida REALTORS®.

2. No Brokerage Relationship Is Created by Using This Site

Using the Site, reading its content, or submitting an inquiry form does not create a brokerage relationship, agency relationship, or fiduciary duty between you and Uplifted Realty. A brokerage relationship arises only through a separate written agreement signed by you and by us.

Under section 475.278, Florida Statutes, Florida real estate licensees are presumed to be operating as transaction brokers unless a single agent or no brokerage relationship is established in writing. Any brokerage relationship we enter into with you will be disclosed and documented as Florida law requires.

3. Informational Content Only

Content on the Site — including market commentary, neighborhood information, articles, and general guidance — is provided for general informational purposes. It is not legal, tax, accounting, financial, insurance, engineering, or construction advice, and it is not a substitute for professional advice on your specific circumstances. Consult a qualified professional before acting.

Nothing on the Site is an appraisal. Any comparative market analysis, broker price opinion, or pricing guidance we provide is prepared by a real estate licensee in the ordinary course of brokerage business under section 475.612, Florida Statutes, and is not an appraisal performed under the Uniform Standards of Professional Appraisal Practice. If you need an appraisal, engage a licensed or certified appraiser.

4. No Property Listings or IDX

The Site does not host an IDX property search and does not display active MLS listings. Any property information referenced on the Site is illustrative. Property availability, pricing, taxes, square footage, lot dimensions, zoning, permitting history, school assignments, HOA and CDD obligations, and flood zone designations change and are frequently reported inaccurately in public and third-party sources. All such information must be independently verified by you and your professional advisors.

5. Fair Housing

Uplifted Realty supports and complies with the federal Fair Housing Act and the Florida Fair Housing Act, sections 760.20 through 760.37, Florida Statutes. We do not discriminate in the sale, rental, or financing of housing, or in brokerage services, on the basis of any protected class. We will not honor discriminatory instructions from any client or customer.

6. Accuracy and Availability

We work to keep the Site accurate and available, but we do not warrant that content is complete, current, or error-free, or that the Site will be uninterrupted or free of harmful components. We may change, suspend, or discontinue any part of the Site at any time without notice.

7. Intellectual Property

The Site and its content — text, photographs, graphics, layout, and the Uplifted Realty name and logo — are owned by us or our licensors and are protected by copyright, trademark, and other laws. You may view and print pages for your personal, non-commercial use. You may not reproduce, republish, distribute, or create derivative works from Site content without our prior written permission.

REALTOR® and associated marks are registered collective membership marks of the National Association of REALTORS® and are used under the terms of membership. Other marks appearing on the Site belong to their respective owners.

8. Photography

Photographs on the Site are our property or are used with permission. Listing photography we produce remains our property unless a written agreement provides otherwise.

9. Prohibited Uses

You agree not to:

Scrape, crawl, harvest, or use automated means to extract data or contact information from the Site
Use the Site or our contact forms to transmit spam, solicitations, or unlawful, defamatory, or harassing material
Attempt to gain unauthorized access to the Site, its server, or any connected system
Interfere with the operation of the Site or circumvent its security features
Use the Site or its content to build or train a competing service, dataset, or model without our written permission
Misrepresent your identity or your affiliation with any person or entity

10. Submissions and Communications

Do not send confidential, financial, or sensitive personal information through the Site’s contact forms or by unencrypted email. Internet transmission is not secure. Information you send us before a written brokerage agreement is in place is not protected by the confidentiality duties that apply within a brokerage relationship.

Information you submit is handled as described in our Privacy Policy. By submitting a form, you consent to our contacting you about your inquiry.

11. Third-Party Links and Services

The Site links to third-party websites and uses third-party services. We do not control them and are not responsible for their content, accuracy, availability, or practices. Links are not endorsements.

12. Copyright Complaints

If you believe content on the Site infringes your copyright, send a written notice under the Digital Millennium Copyright Act to contact@upliftedrealty.com with: your physical or electronic signature; identification of the work claimed to be infringed; identification of the material and its location on the Site; your contact information; a statement of good-faith belief that the use is unauthorized; and a statement, under penalty of perjury, that your notice is accurate and that you are authorized to act for the owner. We remove or disable infringing material upon valid notice.

13. Disclaimer of Warranties

THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. Nothing in this section limits any duty we owe you under a signed brokerage agreement or under Florida real estate law.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, UPLIFTED REALTY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR LOST OPPORTUNITIES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SITE, EVEN IF ADVISED OF THE POSSIBILITY. Our total liability for any claim arising out of the Site is limited to one hundred dollars ($100). Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.

15. Indemnification

You agree to indemnify and hold harmless Uplifted Realty and Konstantin Bogatyrev from any claims, damages, liabilities, and reasonable attorneys’ fees arising out of your misuse of the Site or your violation of these Terms or of applicable law.

16. Governing Law and Venue

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws principles. You agree that the exclusive venue for any dispute arising out of the Site or these Terms is the state or federal courts located in Seminole County, Florida, and you consent to personal jurisdiction there.

17. Severability and Entire Agreement

If any provision of these Terms is held unenforceable, the remaining provisions remain in effect. These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the Site. They do not modify any separate written brokerage, listing, or representation agreement, which controls in the event of a conflict as to its subject matter.

18. Changes to These Terms

We may revise these Terms at any time by posting an updated version with a new “Last updated” date. Your continued use of the Site after a change constitutes acceptance.
